1998 Minnesota Statutes

     93.34 Unlawful to mine under public waters.  

    Subdivision 1.    Authority required.  It shall be 
 unlawful for any individual, copartnership, or corporation to 
 mine any mineral below the low water mark of any public lake or 
 river without first having obtained authority from the state.  

    Subd. 2.    Draining of meandered public lake for mineral 
 purposes forbidden.  It shall be unlawful for any individual, 
 copartnership, or corporation to drain any meandered public lake 
 for the purpose of mining of minerals without first having 
 received the consent of the executive council.  

    Subd. 3.    Violation; penalty.  Any individual, 
 copartnership, or corporation violating the provisions of this 
 section shall upon conviction thereof be punished by a fine of 
 not exceeding $10,000 or by imprisonment in the Minnesota 
 correctional facility-Stillwater for not to exceed five years or 
 by both such fine and imprisonment, at the discretion of the 
 court.
