To calculate the potential to emit GHGs as CO2e for the purpose of determining the applicability of new source review/prevention of significant deterioration (NSR/PSD) and part 70 requirements, biogenic carbon dioxide shall not be included in the total amount of GHGs as CO2e until the date on which biogenic carbon dioxide emissions must be included under federal law. Biogenic carbon dioxide emissions are carbon dioxide emissions resulting from the combustion or decomposition of nonfossilized and biodegradable organic material originating from plants, animals, or microorganisms, including products, by-products, residues, and waste from agriculture, forestry, and related industries as well as the nonfossilized and biodegradable organic fractions of industrial and municipal wastes, including gases and liquids recovered from the decomposition of nonfossilized and biodegradable organic material.
Until the date on which biogenic carbon dioxide emissions must be included under federal law in determining either the applicability of new source review/prevention of significant deterioration or part 70 requirements, biogenic carbon dioxide emissions are also excluded from:
emissions-increase calculations under parts 7007.0100, subpart 14, and 7007.1200, subpart 2 or 3;
