4731.2450 TRANSFER FOR DISPOSAL; MANIFESTS.

Subpart 1.

Purpose.

The requirements of this part and part 4731.2950 are designed to:

A.

control transfers of low-level radioactive waste by any waste generator, waste collector, or waste processor licensee who ships low-level waste directly or indirectly through a waste collector or waste processor to a licensed low-level waste land disposal facility;

B.

establish a manifest tracking system; and

C.

supplement existing requirements concerning transfers and record keeping for those wastes.

Subp. 2.

Manifest required.

A.

A licensee shipping radioactive waste intended for ultimate disposal at a licensed land disposal facility must document the information required by the NRC's Uniform Low-Level Radioactive Waste Manifest and transfer the manifest information to the intended consignee according to part 4731.2950.

B.

A shipment manifest must include a certification by the waste generator according to part 4731.2950, subpart 9.

Subp. 3.

Control and tracking.

A person involved in the transfer for disposal and disposal of waste, including a waste generator, waste collector, waste processor, and disposal facility operator, must comply with part 4731.2950, subparts 10 to 14.

Subp. 4.

Shipping byproduct material.

Any licensee shipping byproduct material, as defined in part 4731.0100, subpart 32, items C and D, intended for ultimate disposal at a land disposal facility licensed under Code of Federal Regulations, title 10, part 61, must document the information on the NRC's Uniform Low-Level Radioactive Waste Manifest and transfer this recorded manifest information to the intended consignee according to part 4731.2950.
