The commissioner may approve the transfer or voluntary demotion of an employee from another public jurisdiction if the following conditions are met:
the employee is currently working in the other public jurisdiction or has worked in the other public jurisdiction within the preceding year;
the position held by the employee in the other public jurisdiction is covered by a personnel system with competitive entry and promotion standards, comparable in duties and responsibilities to the Minnesota classified position, and compensated at a level similar to or higher than the position to which the employee is being transferred or demoted; and
the employee meets the qualifications for the position to which the employee is being transferred or demoted.
The commissioner shall not approve the transfer of an employee to a position funded by a grant-in-aid program from a public jurisdiction without a federally approved merit system.
