An act
relating to commerce; regulating wireless communications device dealer payments for used devices;
amending Minnesota Statutes 2016, section 325E.319, subdivision 4.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
new text begin (a) new text end A wireless communications device dealer shall pay for purchases of all used wireless communications devices by check mailed to a specific address or by electronic transfer.
new text begin (b) The purchase price may be paid in cash if the wireless communications device dealer uses an automated kiosk that: new text end
new text begin (1) uses a live representative to remotely monitor the automated kiosk during all hours of operation; new text end
new text begin (2) in addition to the requirements of subdivision 6, captures and stores in a manner consistent with subdivision 6 images of (i) the identification required by this section, and (ii) the wireless communications device; new text end
new text begin (3) electronically reports all transactions to law enforcement; new text end
new text begin (4) is located within the physical store of a retailer partner; new text end
new text begin (5) otherwise complies with all requirements of this section; and new text end
new text begin (6) only buys wireless communications devices. new text end
new text begin (c) Local law enforcement may require an automated kiosk to close for repairs if for any reason the kiosk is unable to comply with the requirements of this section. new text end
new text begin This section is effective the day following final enactment and applies to cash transactions under this section made on or after that date. new text end
