CHAPTER 165-S.F.No. 9 An act relating to civil service; providing for the abolition of a police civil service commission by a unanimous vote of the city council; amending Minnesota Statutes 1998, sections 419.16 and 419.17. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: Section 1. Minnesota Statutes 1998, section 419.16, is amended to read: 419.16 [DISCONTINUANCEABOLITION OF COMMISSION.]AnyA police civil service commissionhereaftercreatedpursuant to the provisions ofunder this chapter may bediscontinued andabolished as follows: (1) by the voters in accordance with section 419.17; or (2) by a unanimous vote of the city council. Abolition by the voters shall be initiated by a petition signed by at least 25 percent of the number of legal voters voting at the last general municipal electionshall befiled with the governing body ofsuchthe cityand shall requestrequesting that the following question be submitted to the voters: "Shall the police civil service commission be abolished?" Sec. 2. Minnesota Statutes 1998, section 419.17, is amended to read: 419.17 [DISCONTINUANCEABOLITION SUBMITTED TO VOTERS.] Whensucha petition is filed under section 419.16, the governing body ofsuchthe city shall cause the question to be submitted to the voters at the first following general municipal election. The commissionshall be deemed to beis abolished if two-thirds of the votes cast in the electionbeare in favor ofsuchthe abolishment;, and the status of the police department and all oftheits employeesthereofshall thereafterbe deemedtobe the same as if the commission had not been created.
