CHAPTER 114-H.F.No. 813 An act relating to human services; establishing a temporary payment rate for a recently purchased intermediate care facility for persons with mental retardation or related conditions; amending Minnesota Statutes 1994, section 256B.501, by adding a subdivision. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: Section 1. Minnesota Statutes 1994, section 256B.501, is amended by adding a subdivision to read: Subd. 3l. [TEMPORARY PAYMENT RATE PROVISIONS.] If an intermediate care facility for persons with mental retardation or related conditions located in Kandiyohi county: (1) was sold during 1994; (2) is unable to obtain records necessary to complete the cost report from the former operator at no cost; and (3) delicensed two beds during that year, then the commissioner shall determine the payment rate for the period May 1, 1995, through September 30, 1996, as provided in paragraphs (a) to (c). (a) A temporary payment rate shall be paid which is equal to the rate in effect as of April 30, 1995. (b) The payment rate in paragraph (a) shall be subject to a retroactive downward adjustment based on the provisions in paragraph (c). (c) The temporary payment rate shall be limited to the lesser of the payment in paragraph (a) or the payment rate calculated based on the facility's cost report for the reporting year January 1, 1995, through December 31, 1995, and the provisions of this section and the reimbursement rules in effect on June 30, 1995, except that the provisions referred to in clauses (1) to (3) shall not apply: (1) the inflation factor in subdivision 3c; (2) Minnesota Rules, part 9553.0050, subpart 2, items A to E; and (3) Minnesota Rules, part 9553.0041, subpart 16.
