Laws of Minnesota 1991 CHAPTER 167-H.F.No. 743 An act relating to the Red River watershed management board; changing the description of the area subject to special authority of watershed districts; requiring the board to adopt criteria for funding applications; clarifying the uses of levy proceeds; expanding the board's authority to cooperate with other entities; amending Laws 1976, chapter 162, sections 1 and 2, as amended, and 3. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: Section 1. Laws 1976, chapter 162, section 1, as amended by Laws 1982, chapter 474, section 1, Laws 1983, chapter 338, section 1, and Laws 1989 First Special Session chapter 1, article 5, section 45, is amended to read: Section 1. [RED RIVER OF THE NORTH WATERSHED; TAX BY WATERSHED DISTRICTS.] Each watershed district located within the counties of Kittson, Marshall, Polk, Pennington, Red Lake, Norman, Clay, Mahnomen, Clearwater, Roseau, Wilkin, Ottertail, Becker, Koochiching, Beltrami, and Itasca, which district is a member of thelowerRed River watershed management board, established by a joint powers agreement in accordance with Minnesota Statutes, section 471.59, may levy an ad valorem tax not to exceed 0.04836 percent of the taxable market value of all property within the district. This levy shall be in excess of any levy authorized by Minnesota Statutes, section112.61103D.905. The proceeds of one-half of this levy shall be credited to the district'sadministrativeconstruction fund and shall be used for the development, construction, and maintenance of projects and programs ofcommonbenefit to the district. The proceeds of the remaining one-half of this levy shall be credited to theconstructiongeneral fund of thelowerRed River watershed management board and shall be used for funding the development, construction, and maintenance of projects and programs ofcommonbenefit to the Red River basin. The Red River management board shall adopt criteria for member districts to follow in applying for funding from the board. Sec. 2. Laws 1976, chapter 162, section 2, as amended by Laws 1983, chapter 338, section 2, is amended to read: Sec. 2. [RED RIVER WATERSHED MANAGEMENT BOARD PROJECTS.] ThelowerRed River watershed management board may by resolution institute projectsor worksofcommonbenefit to the Red River basin and the expenses of theworks orprojects may be paid in any manner permitted by Minnesota Statutes, chapter112103D, provided, that the limitations of engineers' preliminary cost estimates specified in Minnesota Statutes, section112.48103D.601, subdivision41, shall not be applicable. Sec. 3. Laws 1976, chapter 162, section 3, is amended to read: Sec. 3. [COOPERATION.] ThelowerRed River watershed management board may cooperate with water management and flood control authorities inthe State ofMinnesota, North Dakota, South Dakota, and the province of Manitoba and may enter into contracts, compacts and agreements which may be necessary to insure integration of itsworks orprojects, to control the effects of flooding or to assure the beneficial use of water in thewatershed of theRed Riverand its tributariesbasin.
