Laws of Minnesota 1991 CHAPTER 14-S.F.No. 7 An act relating to crimes; clarifying that alcoholic beverages are prohibited in public elementary and secondary schools; amending Minnesota Statutes 1990, section 624.701, subdivisions 1 and 1a. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: Section 1. Minnesota Statutes 1990, section 624.701, subdivision 1, is amended to read: Subdivision 1. Except as otherwise provided in subdivision 1a, any person who introduces or possesses an alcoholic beverage, as defined in section 340A.101, on any public elementary or secondary school ground,or in anyschoolhouse orpublic elementary or secondary school building,is guilty of a misdemeanor. Sec. 2. Minnesota Statutes 1990, section 624.701, subdivision 1a, is amended to read: Subd. 1a. [EXCEPTIONS.] Subdivision 1 does not apply to the following: (1) experiments in laboratories; (2)those organizationsa person whohavehas been issued a temporarylicenseslicense to sell nonintoxicating malt liquorpursuant tounder section 340A.403, subdivision 2, or intoxicating liquor under section 340A.404, subdivision 10; or (3)anya person possessing nonintoxicating malt liquor or intoxicating liquor as a result of a purchase fromthoseorganizationsa person or organization holding a temporarylicenses pursuant tolicense under section 340A.403, subdivision 2;, or 340A.404, subdivision 10(4) the possession or use of alcoholic beverages in analcohol use awareness program that is held at a post-secondaryschool, sponsored or approved by the school, and limited topersons 21 years old or older. Sec. 3. [EFFECTIVE DATE.] Sections 1 and 2 are effective the day following final enactment and apply to actions occurring on or after that date.
