Laws of Minnesota 1990 CHAPTER 460-S.F.No. 1739 An act relating to metropolitan government; clarifying provisions for compensation; amending Minnesota Statutes 1988, sections 473.123, subdivision 5; and 473.141, subdivision 7; Minnesota Statutes 1989 Supplement, sections 473.605, subdivision 2; and 473.704, subdivision 6; proposing coding for new law in Minnesota Statutes, chapter 375. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: Section 1. Minnesota Statutes 1988, section 473.123, subdivision 5, is amended to read: Subd. 5. [METROPOLITAN COUNCIL; DUTIES AND COMPENSATION.] The metropolitan council shall elect such officers as it deems necessary for the conduct of its affairs other than the chair. A secretary and treasurer need not be members of the metropolitan council. Meeting times and places shall be fixed by the metropolitan council and special meetings may be called by a majority of the members of the metropolitan council or by the chair thereof. Each metropolitan council member other than the chair shall be paida per diem compensation of$50 for eachmeeting and for suchday when the member attends one or more meetings or provides other services, as authorized by the metropolitan council, and shall be reimbursed for reasonable expenses. The annual budget of the council shall provide as a separate account anticipated expenditures for per diem, travel and associated expenses for the chair and members, and compensation or reimbursement shall be made to the chair and members only when budgeted. In the performance of its duties the metropolitan council may promulgate rules governing its operation, establish committees, divisions, departments and bureaus and staff the same as necessary to carry out its duties and when specifically authorized by law make appointments to other governmental agencies and districts. All officers and employees of the metropolitan council shall serve at the pleasure of the appointing authority in the unclassified service of the state civil service. Rules promulgated by the metropolitan council shall be in accordance with the administrative procedure provisions contained in chapter 14. Sec. 2. Minnesota Statutes 1988, section 473.141, subdivision 7, is amended to read: Subd. 7. [COMPENSATION.] Each commission member shall be paida per diem compensation of$50 for eachmeeting and forsuchday when the member attends one or more meetings or provides other services, as authorized by the commission, and shall be reimbursed for all actual and necessary expenses incurred in the performance of duties in the same manner and amount as state employees. The chair shall receive a salary in an amount fixed by section 15A.081 and shall be reimbursed for reasonable expenses to the same extent as a member; provided that the chair of the metropolitan sports facilities commission shall receive, unless otherwise provided by other law, a salary in an amount fixed by the members of the commission and shall be reimbursed for reasonable expenses to the same extent as a member. The annual budget of each commission shall provide as a separate account anticipated expenditures for per diem, travel and associated expenses for the chair and members, and compensation or reimbursement shall be made to the chair and members only when budgeted. Sec. 3. Minnesota Statutes 1989 Supplement, section 473.605, subdivision 2, is amended to read: Subd. 2. Each commission member shallbe paid a per diemcompensation of $50 for each meeting of the commission, one ofits committees, and attendance and participation at a meeting orhearing as a representative of the commission pursuant to statelaw or rule. Members shall be reimbursed for all actual andnecessary expenses incurred in the performance of their dutiesin the same manner and amount as state employees.receive per diem compensation and be reimbursed for expenses as provided by section 473.141, subdivision 7. The chair shall receive a salary as prescribed in section 15A.081, subdivision 7, and shall be reimbursed for reasonable expenses to the same extent as a member. The mayors and members of the city councils of Minneapolis and St. Paul shall not be eligible for per diem compensation. The annual budget of the commission shall provide as a separate account anticipated expenditures for per diem, travel, and associated expenses for the chair and members, and compensation or reimbursement shall be made to the chair and members only when budgeted. Sec. 4. Minnesota Statutes 1989 Supplement, section 473.704, subdivision 6, is amended to read: Subd. 6. It may reimburse commissioners and employees for expenses necessarily incurred or paid in performance of their duties and providereasonableper diem as provided by section 473.141, subdivision 7. Sec. 5. [APPLICATION.] Sections 1 to 4 apply in the counties of Anoka, Carver, Dakota, Hennepin, Ramsey, Scott, and Washington. Sec. 6. [375.065] [MEETINGS, PAY.] A member of the county board of a county who is paid a salary that is more than 50 percent of the salary of the governor may not be paid any amount, by per diem or otherwise, except as reimbursement for expenses, for attendance at meetings related to the business of any local government unit.
