Laws of Minnesota 1990 CHAPTER 444-S.F.No. 1794 An act relating to veterans; redefining the term "veteran"; setting criteria for educational assistance; amending Minnesota Statutes 1988, sections 197.447; and 197.75, subdivision 2. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: Section 1. Minnesota Statutes 1988, section 197.447, is amended to read: 197.447 [VETERAN, DEFINED.] The word "veteran" as used in Minnesota Statutes except in sections43A.11, 196.02, 196.07, 197.59, 197.601136C.13, 196.21, 197.971, and202.038243.251, meansany persona citizen of the United States or a resident alien who has been separated under honorable conditions from any branch of the armed forces of the United States after having served on active duty for 181 consecutive days or by reason of disability incurred while serving on active duty,and who is a citizen ofthe United States or resident alienor who has active military service certified under section 401, Public Law Number 95-202. The active military service must be certified by the United States Secretary of Defense as active military service and a discharge under honorable conditions must be issued by the Secretary. Sec. 2. Minnesota Statutes 1988, section 197.75, subdivision 2, is amended to read: Subd. 2. [LIMITATIONS.]None ofTheprovisions ofbenefits in subdivision 1shall be madeare not available toanya veteran who is entitled to the same or similar benefits underanya law or regulation of the United Statesnow in forceor hereafter created, unless the, with the exceptions in paragraphs (a) and (b). (a) A veteranshall havewho has been eligible for andexhaustedhas used up the benefits the veteran is entitled to under the laws of the United States, through use thereof, inwhich event the veteran shall beis entitled to the benefits provided for by subdivision 1. (b) A veteran who has had less than ten years of eligibility for educational assistance under federal law because of the December 31, 1989, delimiting date and who has lost more than four months of that eligibility is entitled to the benefits provided for by subdivision 1.
