Laws of Minnesota 1990 CHAPTER 369-S.F.No. 1663 An act relating to local government; abandoning judicial ditch number 17 in Redwood and Lyon counties; authorizing the Faribault county local redevelopment agency board to have nine members. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: Section 1. [ABANDONMENT OF JUDICIAL DITCH NUMBER 37; REDWOOD AND LYON COUNTIES.] Notwithstanding Minnesota Statutes, section 106A.805 or 106A.811, judicial ditch number 37 in Redwood and Lyon counties from Seaforth to trunk highway number 23 north of Marshall is abandoned and no longer a public drainage system but is part of the Redwood river. After the effective date of this act, a repair petition for the area abandoned may not be accepted and the responsibility of the drainage authority for the maintenance of the drainage system ends. This act does not release the area that is abandoned from a drainage lien or assessment filed before the effective date of this act. Sec. 2. [FARIBAULT COUNTY LOCAL REDEVELOPMENT AGENCY.] Notwithstanding Minnesota Statutes, section 469.111, subdivision 5, the board of commissioners of the Faribault county local redevelopment agency shall consist of not less than five members nor more than nine members. The county board shall fix their terms so that no more than two expire in any calendar year. Sec. 3. [EFFECTIVE DATE.] Section 1 is effective on approval of the Redwood and Lyon county boards as provided in Minnesota Statutes, section 645.023. Section 2 is effective the day after the Faribault county board complies with Minnesota Statutes, section 645.021, subdivision 3.
