Laws of Minnesota 1989 CHAPTER 61-S.F.No. 936 An act relating to state lands; authorizing exchange of state property with city of St. Cloud. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: Section 1. [EXCHANGE OF UNIVERSITY PROPERTY WITH ST. CLOUD PROPERTY.] Subdivision 1. [AUTHORIZATION.] Notwithstanding Minnesota Statutes, sections 94.341 to 94.349, subject to the approval of the land exchange board and the city of St. Cloud, the state of Minnesota shall exchange the St. Cloud State University real property described in subdivision 3 for the property of the city of St. Cloud, described in subdivision 4, without delay. Subd. 2. [FORM OF EXCHANGE.] The exchange must be in a form approved by the attorney general. Subd. 3. [UNIVERSITY PROPERTY.] The state may exchange the property described in this subdivision for the property owned by the city of St. Cloud, described in subdivision 4. That part of Lots 8, 9, 10, 11 and 12, Block 37, Curtis Survey, City of St. Cloud, according to the recorded plat thereof, on file in the office of the county recorder, Stearns County, being more particularly described as follows: Commencing at the Northwest corner of said block, thence South 00 degrees, 41 minutes, 26 seconds East, assumed bearing, along the West line of said block a distance of 78.69 feet to the point of beginning of the parcel to be described; thence southeasterly along a tangential curve concave to the Northeast, having a central angle of 37 degrees, 49 minutes, 38 seconds, a radius of 410 feet and a distance of 270.68 feet to the South line of said block; thence South 89 degrees, 19 minutes, 48 seconds West along said South block line, a distance of 86.14 feet to the Southwest corner of said block, thence North 00 degrees, 41 minutes, 26 seconds West along said West block line a distance of 251.41 feet to the point of beginning. Said parcel is subject to existing easements of record. Parcel contains 6884 square feet. Subd. 4. [CITY PROPERTY.] The city of St. Cloud may exchange the real property described in this subdivision for the real property owned by the state and described in subdivision 3. Lot 11, Block 36, Curtis Survey, City of St. Cloud, according to the recorded plat thereof, on file in the office of the county recorder, Stearns County. Subject to existing easements of record. Parcel contains 7260 square feet. Subd. 5. [PURPOSE.] The purpose of this property exchange is to accommodate the realignment of the right-of-way of Fifth Avenue in St. Cloud. Sec. 2.
