Laws of Minnesota 1988 CHAPTER 678-H.F.No. 1865 An act relating to the town of White Bear; authorizing the town of White Bear to establish an economic development authority and economic development districts, and to exercise tax increment financing powers; giving the town of White Bear the powers of a city with respect to the authority. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: Section 1. [TOWN OF WHITE BEAR; ECONOMIC DEVELOPMENT.] Subdivision 1. [ECONOMIC DEVELOPMENT AUTHORITY.] The town of White Bear may establish an economic development authority. The town must establish the authority in the manner provided in Minnesota Statutes, sections 469.091 to 469.101, and may impose the limits on the authority enumerated in Minnesota Statutes, section 469.092. An authority established under this subdivision has all the powers and duties granted to or imposed upon economic development authorities under Minnesota Statutes, sections 469.090 to 469.106 and 469.174 to 469.178. Subd. 2. [POWERS OF A CITY OR MUNICIPALITY.] The town of White Bear and its governing body have all the powers and duties granted to or imposed on (1) a city and the governing body of a city under Minnesota Statutes, sections 469.090 to 469.107, including the power to levy a tax subject to referendum under Minnesota Statutes, section 469.107; and (2) a municipality and the governing body of a municipality under Minnesota Statutes, sections 469.174 to 469.178 with respect to a project undertaken by an economic development authority under subdivision 1. Sec. 2. [TOWN OF WHITE BEAR; DEVELOPMENT DISTRICT.] Subdivision 1. [DEVELOPMENT DISTRICT.] The town of White Bear may establish one or more economic development districts to facilitate development within the town and for such purpose may exercise all of the powers granted to a city under Minnesota Statutes, sections 469.124 to 469.134. Subd. 2. [TAX INCREMENT FINANCING.] The town of White Bear and its governing body have all the powers and duties granted to or imposed on a city and the governing body of a city under Minnesota Statutes, sections 469.174 to 469.179, with respect to any development undertaken in a development district created pursuant to subdivision 1. Sec. 3. [LOCAL APPROVAL; EFFECTIVE DATE.] Under Minnesota Statutes, section 645.023, subdivision 1, paragraph (a), sections 1 and 2 are effective without local approval July 1, 1988.
