Laws of Minnesota 1985 CHAPTER 13-H.F.No. 329 An act relating to peace officers; requiring a person seeking appointment as a part-time peace officer to provide the board of peace officer standards and training with proof that he or she has complied with appointment requirements; amending Minnesota Statutes 1984, section 626.8463. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: Section 1. Minnesota Statutes 1984, section 626.8463, is amended to read: 626.8463 [PART-TIME PEACE OFFICERS.] Subdivision 1. [APPOINTMENT REQUIREMENTS.] Any individual appointed or employed as a part-time peace officerto a positionwhich was filled by a part-time officer between January 1, 1978and May 31, 1979 owing to the death, termination, or failure ofthe incumbent to comply with the requirements of this sectionshall provide proof to the board that the individual has:(a)(1)Within six months of his appointment he hassatisfied the selection standards of the board then in effect.The board shall grant a reasonable extension of time to showsatisfaction of selection standards to any law enforcementagency that demonstrates that satisfaction of selectionstandards within six months would impose financial hardship;(b)(2)Within 12 months of his appointment he hassuccessfully completedaboardcertified course, or aprofessionallyrecognizedprogram,courses in first aid,and,if authorized to carry a firearm on duty,firearms training, including legal limitations on the justifiable use of deadly force; and(c)(3)Within 24 months of his appointment he hassuccessfully passed a board part-time peace officer licensing examination. Subd. 2. [QUOTA.] A law enforcement agency maydesignatepersonnel as part-time peace officer replacements who shall besubject to the training requirements of this sectionnotwithstanding the fact that the personnel are appointed topositions which were not filled by part-time officers betweenJanuary 1, 1978 and May 31, 1979. Provided that the number ofpersonnel so designated shall not exceed a number equal to twoor ten percent of the positions filled by part-time officersbetween January 1, 1978 and May 31, 1979, rounded to the nexthighest whole number, whichever is greaterhave no more than two part-time peace officer positions, except that the agency may have up to the number of part-time peace officer positions recognized by the board as of January 1, 1985.
