Laws of Minnesota 1984 CHAPTER 444-H.F.No. 1656 An act relating to commerce; motor fuel franchises; providing for a temporary prohibition on certain building alterations that eliminate service bays. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: Section 1. [DEFINITIONS.] Subdivision 1. [TERMS.] As used in this act, the terms defined in this section have the meanings given them. Subd. 2. [FULL-SERVICE STATION.] "Full-service station" means any place of business where motor vehicle fuel is sold and delivered into the tanks of motor vehicles and has an enclosed area where automobile repairs are offered to consumers, including, but not limited to, lubrication, oil change, tire repair, battery charge, replacement of fan belts, hoses, and wiper blades. Subd. 3. [SERVICE BAYS.] "Service bays" are enclosed areas where automobile repairs are performed, including, but not limited to, lubrication, oil change, tire repair, battery charge, replacement of fan belts, hoses, and wiper blades. Sec. 2. [ELIMINATION OF SERVICE BAYS PROHIBITED.] Subdivision 1. [BUILDING ALTERATIONS.] No motor fuel franchisor shall alter a full-service station building for the purpose of eliminating the service bays unless the motor fuel franchisee operating the full-service station consents in writing to the alterations. Subd. 2. [LIMITATION.] Nothing in this section prohibits a motor fuel franchisor from altering a full-service station that is not operated by a franchisee. Sec. 3. [ENFORCEMENT.] The attorney general or any aggrieved party may institute a civil action in the district court for an injunction prohibiting any violation of section 2. It shall be no defense to such an action that the state or aggrieved party may have adequate remedies at law. Sec. 4. [REPEALER.] This act is repealed on July 1, 1986. Sec. 5. [EFFECTIVE DATE.] This act is effective the day following final enactment. Approved April 23, 1984
