Laws of Minnesota 1983 CHAPTER 354--S.F.No. 591 An act relating to insurance; health and accident; prohibiting provider discrimination in insurance policies covering mental health services; amending Minnesota Statutes 1982, section 62A.152, by adding a subdivision. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: Section 1. Minnesota Statutes 1982, section 62A.152, is amended by adding a subdivision to read: Subd. 3. [PROVIDER DISCRIMINATION PROHIBITED.] All group policies and group subscriber contracts that provide benefits for mental or nervous disorder treatments in a hospital must provide direct reimbursement for those services if performed by a licensed consulting psychologist to the extent that the services and treatment are within the scope of licensed consulting psychologist licensure. The order of the physician requesting the services of the licensed consulting psychologist may be required to be submitted with the claim for payment. This subdivision is intended to provide payment of benefits for mental or nervous disorder treatments performed by a licensed consulting psychologist in a hospital and is not intended to change or add benefits for those services provided in policies or contracts to which this subdivision applies. Sec. 2. [EFFECTIVE DATE; APPLICATION.] Section 1 is effective July 1, 1983 and applies to all applicable policies and contracts issued, renewed, or delivered on or after that date.
