Laws of Minnesota 1983 CHAPTER 256--H.F.No. 904 An act relating to transportation; establishing collective rate-making procedure for motor vehicle carriers; proposing new law coded in Minnesota Statutes, chapter 221. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: Section 1. [221.165] [COLLECTIVE RATE-MAKING.] In order to ensure nondiscriminatory rates and charges for shippers and receivers, the board shall establish a collective rate-making procedure which will ensure the publication and maintenance of just and reasonable rates and charges under uniform, reasonably related rate structures. This procedure must provide for the joint consideration, initiation, and establishment of rates and charges, and must ensure that respective revenues and expenses of carriers engaged in such transportation are ascertained. A participating carrier party to a collectively mandated rate or charge shall have the right to petition the board for the establishment of a rate or charge deviating from the collectively set rate. Upon receiving board approval, the carrier may proceed to establish the requested rate or charge. Motor carriers subject to rate regulation under this chapter are required to comply with the rate-making procedure. Sec. 2. [PUBLIC UTILITIES COMMISSION.] Prior to the effective date of Laws 1980, chapter 534, as amended by Laws 1981, chapter 357, section 108, the public utilities commission shall perform the duties of the board under section 1.
