Laws of Minnesota 1983 CHAPTER 169--S.F.No. 752 An act relating to crimes; prohibiting assaulting a peace officer; prescribing penalties; amending Minnesota Statutes 1982, section 609.224; proposing new law coded in Minnesota Statutes, chapter 609. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: Section 1. [609.2231] [ASSAULT IN THE FOURTH DEGREE.] Whoever assaults a peace officer when that officer is effecting a lawful arrest or executing any other duty imposed upon him by law and inflicts demonstrable bodily harm is guilty of a felony and may be sentenced to imprisonment for not more than one year and a day or to payment of a fine of not more than $1,000, or both. Sec. 2. Minnesota Statutes 1982, section 609.224, is amended to read: 609.224 [ASSAULT IN THEFOURTHFIFTH DEGREE.] Whoever does any of the following commits an assault and is guilty of a misdemeanor: (1) Does an act with intent to cause fear in another of immediate bodily harm or death; or (2) Intentionally inflicts or attempts to inflict bodily harm upon another. Sec. 3. [INSTRUCTIONS TO REVISOR.] In the next edition of Minnesota Statutes, the revisor of statutes shall change any reference to "assault in the fourth degree" to read "assault in the fifth degree" if the reference is to section 609.224. Sec. 4. [EFFECTIVE DATE.] Sections 1 to 3 are effective the day after final enactment and apply to all crimes committed on or after that date. Approved May 19, 1983
