A bill for an act
relating to liquor; imposing a criminal penalty for social host liability; amending
Minnesota Statutes 2010, section 340A.90, by adding a subdivision.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2010, section 340A.90, is amended by adding a
subdivision to read:

(a) A person 21 years of age or
older who: (1) had control over the premises and, being in a reasonable position to prevent
the consumption of alcoholic beverages by a person under the age of 21 years, knowingly
or recklessly permitted that consumption and the consumption caused the intoxication of
that person; or (2) sold, bartered, furnished or gave to, or purchased for a person under the
age of 21 years alcoholic beverages that caused the intoxication of that person is guilty,
upon a second conviction, of a gross misdemeanor.

(b) Paragraph (a) does not apply to the landlord or manager of a multiple dwelling
or rental residential property who does not actively participate in providing an alcoholic
beverage to a person under the age of 21 years.

This section is effective August 1, 2011, and applies to crimes
committed on or after that date.
