1.1 A bill for an act 1.2 relating to alcoholic beverages; removing statutory 1.3 minimum restaurant seating capacities and permitting 1.4 the local license issuing authority to establish 1.5 minimum restaurant seating capacities; amending 1.6 Minnesota Statutes 1994, section 340A.101, subdivision 1.7 25. 1.8 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.9 Section 1. Minnesota Statutes 1994, section 340A.101, 1.10 subdivision 25, is amended to read: 1.11 Subd. 25. [RESTAURANT.] "Restaurant" is an establishment, 1.12 other than a hotel, under the control of a single proprietor or 1.13 manager, where meals are regularly prepared on the premises and 1.14 served at tables to the general public, and having a minimum 1.15 seating capacity for guestsin the following minimum numbers:as 1.16 prescribed by the appropriate license issuing authority. 1.17(a) First class cities501.18(b) Second and third class cities1.19and statutory cities of over1.2010,000 population301.21(c) Unincorporated or unorganized1.22territory other than in Cook,1.23Itasca, Lake, Lake of the Woods,1.24and St. Louis counties1001.25(d) Unincorporated or unorganized1.26territory in Cook, Itasca, Lake,2.1Lake of the Woods, and St. Louis2.2counties502.3In the case of classes (b) and (c) above, the governing2.4body of a city or county may prescribe a higher minimum number.2.5In fourth class cities and statutory cities under 10,0002.6population, minimum seating requirements are those prescribed by2.7the governing body of the city.
