  1.1                          A bill for an act 
  1.2             relating to health; providing for education of 
  1.3             parents, primary caregivers, and child care providers 
  1.4             on the dangers associated with shaking infants and 
  1.5             young children; proposing coding for new law in 
  1.6             Minnesota Statutes, chapters 144; 245A. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [144.574] [EDUCATION ABOUT THE DANGERS OF 
  1.9   SHAKING INFANTS AND YOUNG CHILDREN.] 
  1.10     Subdivision 1.  [EDUCATION BY HOSPITALS.] (a) A hospital 
  1.11  licensed under sections 144.50 to 144.56 shall make available 
  1.12  for viewing by the parents of each newborn baby delivered in the 
  1.13  hospital a video presentation on the dangers associated with 
  1.14  shaking infants and young children. 
  1.15     (b) A hospital shall use a video obtained from the 
  1.16  commissioner or approved by the commissioner.  The commissioner 
  1.17  shall provide to a hospital at cost copies of an approved 
  1.18  video.  The commissioner shall review other video presentations 
  1.19  for possible approval upon the request of a hospital.  The 
  1.20  commissioner shall not require a hospital to use videos that 
  1.21  would require the hospital to pay royalties for use of the 
  1.22  video, restrict viewing in order to comply with public viewing 
  1.23  or other restrictions, or be subject to other costs or 
  1.24  restrictions associated with copyrights. 
  1.25     (c) A hospital shall, whenever possible, request both 
  1.26  parents to view the video.  The patient's chart shall indicate 
  2.1   whether the parents are offered an opportunity to view the video.
  2.2      (d) The showing or distribution of the video shall not 
  2.3   subject any person or facility to any action for damages or 
  2.4   other relief provided the person or facility acted in good faith.
  2.5      Subd. 2.  [EDUCATION BY HEALTH CARE PROVIDERS.] The 
  2.6   commissioner shall establish a protocol for health care 
  2.7   providers to educate parents and primary caregivers about the 
  2.8   dangers associated with shaking infants and young children.  The 
  2.9   commissioner shall request family practice physicians, 
  2.10  pediatricians, and other pediatric health care providers to 
  2.11  review these dangers with the parents and primary caregivers of 
  2.12  infants and young children up to the age of three at each 
  2.13  well-baby visit. 
  2.14     Sec. 2.  [245A.034] [CHILD CARE PROVIDER TRAINING; DANGERS 
  2.15  OF SHAKING INFANTS AND YOUNG CHILDREN.] 
  2.16     The commissioner shall make available for viewing by all 
  2.17  licensed and legal nonlicensed child care providers a video 
  2.18  presentation on the dangers associated with shaking infants and 
  2.19  young children.  The video presentation shall be part of the 
  2.20  initial and ongoing training of licensed child care providers.  
  2.21  Legal nonlicensed child care providers may participate at their 
  2.22  option in a video presentation session offered under this 
  2.23  section.  The commissioner shall provide to child care providers 
  2.24  at cost copies of a video approved by the commissioner of health 
  2.25  under section 144.574 on the dangers associated with shaking 
  2.26  infants and young children.
