1.1 A bill for an act 1.2 relating to education; modifying the referendum and 1.3 supplemental revenue reduction; amending Minnesota 1.4 Statutes 1994, sections 124A.03, subdivision 3b; and 1.5 124A.22, subdivision 9. 1.6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.7 Section 1. Minnesota Statutes 1994, section 124A.03, 1.8 subdivision 3b, is amended to read: 1.9 Subd. 3b. [REFERENDUM ALLOWANCE REDUCTION.]A district's1.10 For districts whose referendum allowanceunder subdivision 1c is1.11reduced byexceeds 25 percent of the formula allowance, the 1.12amounts calculated in paragraphs (a), (b), (c), and1.13(d)referendum allowance is equal to the greater of: 1.14 (1) the referendum allowance less the difference between 1.15 the formula allowance for the current fiscal year and $3,050; or 1.16 (2) 25 percent of the formula allowance for the current 1.17 fiscal year. 1.18(a) The referendum allowance reduction equals the amount by1.19which a district's supplemental revenue reduction exceeds the1.20district's supplemental revenue allowance for fiscal year 1993.1.21(b) Notwithstanding paragraph (a), if a district's initial1.22referendum allowance is less than ten percent of the formula1.23allowance for that year, the reduction equals the lesser of (1)1.24an amount equal to $100, or (2) the amount calculated in1.25paragraph (a).2.1(c) Notwithstanding paragraph (a) or (b), a school2.2district's referendum allowance reduction equals (1) an amount2.3equal to $100, times (2) one minus the ratio of 20 percent of2.4the formula allowance minus the district's initial referendum2.5allowance limit to 20 percent of the formula allowance for that2.6year if:2.7(i) the district's adjusted net tax capacity for assessment2.8year 1992 per actual pupil unit for fiscal year 1995 is less2.9than $3,000;2.10(ii) the district's net unappropriated operating fund2.11balance as of June 30, 1993, divided by the actual pupil units2.12for fiscal year 1995 is less than $200;2.13(iii) the district's supplemental revenue allowance for2.14fiscal year 1993 is equal to zero; and2.15(iv) the district's initial referendum revenue authority2.16for the current year divided by the district's net tax capacity2.17for assessment year 1992 is greater than ten percent.2.18(d) Notwithstanding paragraph (a), (b), or (c), the2.19referendum revenue reduction for a newly reorganized district is2.20computed as follows:2.21(1) for a newly reorganized district created effective July2.221, 1994, the referendum revenue reduction equals the lesser of2.23the amount calculated for the combined district under paragraph2.24(a), (b), or (c), or the sum of the amounts by which each of the2.25reorganizing district's supplemental revenue reduction exceeds2.26its respective supplemental revenue allowances calculated for2.27the districts as if they were still in existence for fiscal year2.281995; or2.29(2) for a newly reorganized district created after July 1,2.301994, the referendum revenue reduction equals the lesser of the2.31amount calculated for the combined district under paragraph (a),2.32(b), or (c), or the sum of the amounts by which each of the2.33reorganizing district's supplemental revenue reduction exceeds2.34its respective supplemental revenue allowances calculated for2.35the year preceding the year of reorganization.2.36 Sec. 2. Minnesota Statutes 1994, section 124A.22, 3.1 subdivision 9, is amended to read: 3.2 Subd. 9. [SUPPLEMENTAL REVENUE REDUCTION.] A district's 3.3 supplemental revenue allowance is reduced by the sum of: 3.4 (1) the sum of one-fourth of the difference of: 3.5 (i) the sum of the district's training and experience 3.6 revenue and compensatory revenue per actual pupil unit for that 3.7 fiscal year, and 3.8 (ii) the sum of district's training and experience revenue 3.9 and compensatory revenue per actual pupil unit for fiscal year 3.10 1994; and 3.11 (2)the difference between the formula allowance for the3.12current fiscal year and $3,050$100. 3.13 A district's supplemental revenue allowance may not be less 3.14 than zero. 3.15 Sec. 3. [REFERENDUM ALLOWANCE ADJUSTMENT.] 3.16 Any school district whose referendum allowance for fiscal 3.17 year 1996 is not reduced according to section 1, and whose 3.18 referendum allowance for fiscal year 1995 was reduced according 3.19 to Minnesota Statutes 1994, section 124A.03, subdivision 3b, may 3.20 increase its referendum allowance by the amount of the 3.21 reduction. The district's adjusted referendum allowance must 3.22 not exceed $850. 3.23 Sec. 4. [EFFECTIVE DATE.] 3.24 Sections 1 and 2 are effective July 1, 1995. 3.25 Section 3 is effective for revenue for fiscal year 1996.
