1.1A bill for an act
1.2relating to insurance coverage; requiring the commissioner of commerce to
1.3establish an open enrollment period for child-only health plans.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. OPEN ENROLLMENT PERIOD FOR CHILD-ONLY HEALTH
1.6PLANS.
1.7(a) The commissioner of commerce, in consultation with representatives of the
1.8health plan companies, shall establish a mandatory open enrollment period or periods in
1.9which health plan companies offering or issuing child-only individual health plans within
1.10the state must offer coverage on a guaranteed-issue basis to children under the age of 19.
1.11(b) The commissioner shall determine the number and length of the open enrollment
1.12periods so long as an initial open enrollment period is commenced before December 31,
1.132010, for a period of at least 30 days, and at least one open enrollment period occurs
1.14annually for a period of at least 30 days.
1.15EFFECTIVE DATE.This section is effective the day following final enactment.
