A bill for an act
relating to environment; prohibiting permitting of commercial hazardous waste
incineration facilities; amending Minnesota Statutes 2008, section 115A.03,
by adding a subdivision; proposing coding for new law in Minnesota Statutes,
chapter 115A.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2008, section 115A.03, is amended by adding a
subdivision to read:

"Commercial
hazardous waste incineration facility" means a facility that accepts hazardous waste for
incineration within Minnesota from generators other than the owner and operator of the
facility. Commercial hazardous waste incineration facility does not include a hazardous
waste incineration facility that accepts small quantities of hazardous wastes from public
bodies on an emergency basis at no cost with the approval of the commissioner or a
mixed municipal solid waste facility.
