A bill for an act
relating to transportation; authorizing road authority to issue annual permit for
overweight vehicle transporting milk under certain circumstances; amending
Minnesota Statutes 2009 Supplement, section 169.865, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2009 Supplement, section 169.865, is amended by
adding a subdivision to read:

new text begin Vehicles hauling milk. new text end

new text begin (a) A road authority may issue an annual permit
authorizing a vehicle or combination of vehicles with a total of three, four, or five axles to
haul milk and be operated with a gross vehicle weight of up to:

new text begin (1) 90,000 pounds; or
new text end

new text begin (2) 99,000 pounds during the winter increase period set by the commissioner under
section 169.826, subdivision 1.

new text begin (b) A permit may not be issued under this subdivision for the same vehicle or
combination of vehicles more than three times.

new text begin (c) A permit may be issued under this subdivision only if the applicant attests in
writing to an intent to utilize, within three years of the date of the initial application, only
six-axle or seven-axle vehicles or vehicle combinations to transport milk.

new text begin (d) The fee for a permit issued under this subdivision is $200.
