1.1 A bill for an act 1.2 relating to human services; modifying the 1.3 reimbursement rate for hospital services provided to a 1.4 polio patient; amending Minnesota Statutes 2002, 1.5 section 256B.31. 1.6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.7 Section 1. Minnesota Statutes 2002, section 256B.31, is 1.8 amended to read: 1.9 256B.31 [CONTINUED HOSPITAL CARE FOR LONG-TERM POLIO 1.10 PATIENT.] 1.11 A medical assistance recipient who has been a polio patient 1.12 in an acute care hospital for a period of not less than 25 1.13 consecutive years is eligible to continue receiving hospital 1.14 care, whether or not the care is medically necessary for 1.15 purposes of federal reimbursement. The cost of continued 1.16 hospital care not reimbursable by the federal government must be 1.17 paid with state money allocated for the medical assistance 1.18 program. The rate paid to the hospital is therate per day1.19established using Medicare principles for the hospital's fiscal1.20year ending December 31, 1981, adjusted each year by the annual1.21hospital cost index established under section 256.969,1.22subdivision 1, or by other limits in effect at the time of the1.23adjustmentaverage inpatient routine rate per day for non-MFIP 1.24 eligibles, excluding rehabilitation and neonate admissions but 1.25 including property, for hospitals located outside of a 2.1 metropolitan statistical area, as defined by the United States 2.2 Census Bureau. This section does not prohibit a voluntary move 2.3 to another living arrangement by a recipient whose care is 2.4 reimbursed under this section.
