1.1                                        A bill for an act
1.2     relating to state government; adding an ex officio member to the Indian Affairs 
1.3     Council; amending Minnesota Statutes 2004, section 3.922, subdivision 1.
1.4     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5         Section 1. Minnesota Statutes 2004, section 3.922, subdivision 1, is amended to read:
1.6         Subdivision 1. Creation, membership.  The state Indian Affairs Council is created 
1.7     to consist of the following ex officio members:
1.8     the governor or a member of the governor's official staff designated by the governor,
1.9     the commissioner of education,
1.10    the commissioner of human services,
1.11    the commissioner of natural resources,
1.12    the commissioner of human rights,
1.13    the commissioner of employment and economic development,
1.14    the commissioner of corrections,
1.15    the commissioner of the Minnesota Housing Finance Agency,
1.16    the commissioner of Iron Range resources and rehabilitation,
1.17    the commissioner of health,
1.18    the commissioner of transportation,
1.19    the commissioner of administration,
1.20    each of whom may designate a staff member to serve instead, and
1.21    three members of the house of representatives appointed by the speaker, and three 
1.22    members of the senate appointed by its Subcommittee on Committees.
1.23    Voting members of the council are the elected tribal chair of:
2.1     the Fond du Lac Reservation Business Committee;
2.2     the Grand Portage Reservation Business Committee;
2.3     the Mille Lacs Reservation Business Committee;
2.4     the White Earth Reservation Business Committee;
2.5     the Bois Forte (Nett Lake) Reservation Business Committee;
2.6     the Leech Lake Reservation Business Committee;
2.7     the Red Lake Tribal Council;
2.8     the Upper Sioux board of trustees;
2.9     the Lower Sioux Tribal Council;
2.10    the Shakopee-Mdewankanton General Council;
2.11    the Prairie Island Tribal Council; and
2.12    two members to be selected under subdivision 2.
2.13    The chairs of the Indian committees, trusts, or councils may designate in writing a member 
2.14    who has been elected at large to an office in the committee, trust, or council, to serve 
2.15    instead.  Members appointed to represent the house of representatives, the senate or tribal 
2.16    governments shall no longer serve on the council when they are no longer members of the 
2.17    bodies which they represent and their offices shall be vacant.  A member who is a designee 
2.18    of a tribal chair shall cease to be a member at the end of the term of the designating tribal 
2.19    chair.  Ex officio members or their designees on the council shall not vote.
