A bill for an act
relating to local government; prohibiting fees on merchant-provided plastic bags
and reuse of bags during peacetime public health emergency.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

new text begin (a) During a peacetime public health emergency:
new text end

new text begin (1) a local government ordinance that imposes or requires a merchant to impose a fee
for a merchant-provided paper or plastic bag for packaging of any item or good purchased
from a merchant, itinerant vendor, or peddler is suspended and must not be enforced; and

new text begin (2) a merchant must not permit customers to bring onto the merchant's premises used
bags.

new text begin (b) For purposes of this section, "peacetime public health emergency" means any
peacetime emergency declared by the governor in an executive order that is related to the
infectious disease known as COVID-19.

new text begin EFFECTIVE DATE. new text end

new text begin This section is effective the day following final enactment and
expires the day following the expiration of the declaration of the peacetime public health
emergency.
