A bill for an act
relating to energy; clarifying that a certain facility does not violate the exclusive
service territory law.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

The owner and operator of an electric generation facility located in Faribault County
consisting of two wind turbines is not an electric utility for the purpose of Minnesota
Statutes, section 216B.40, if the turbines are located adjacent to an ethanol plant and the
electricity produced by the turbines is used primarily for the operations of the ethanol
plant. The providing of electric service by those two turbines to the ethanol plant is not
subject to Minnesota Statutes, section 216B.40, and does not require the consent of the
electric utility in whose service area the plant is located.
