A bill for an act
relating to agriculture; requiring reimbursement of certain persons who control or
eradicate noxious weeds on a trunk highway right-of-way; amending Minnesota
Statutes 2016, section 18.78, subdivision 1.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Section 1.
Minnesota Statutes 2016, section 18.78, subdivision 1, is amended to read:
Subdivision 1.
Generally.
A person owning land, a person occupying land, or a person
responsible for the maintenance of public land shall control or eradicate all noxious weeds
on the land at a time and in a manner ordered by an inspector or county-designated employee.new text begin
Notwithstanding section 3.736, subdivision 3, if the commissioner of transportation fails
to control or eradicate noxious weeds on a trunk highway right-of-way as provided in a
general weed notice published under section 18.83 or otherwise ordered by an inspector or
county-designated employee, the commissioner of transportation must fully reimburse the
owner or occupant of land adjacent to the right-of-way for the owner or occupant's
documented costs to control or eradicate noxious weeds on the right-of-way.
