A bill for an act
relating to waters; modifying watershed district provisions; amending Minnesota
Statutes 2004, sections 103D.271, subdivision 7; 103D.315, by adding a
subdivision; repealing Minnesota Statutes 2004, section 103D.271, subdivision 6.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2004, section 103D.271, subdivision 7, is amended to
read:
When the board determines a termination
petition has been filed that meets the requirements of subdivisions 4 and 5 deleted text begin and the
petitioners' bond has been fileddeleted text end , the board must, by order, set a time by 35 days after its
determination and a location within the watershed district for a termination hearing.
Minnesota Statutes 2004, section 103D.315, is amended by adding a
subdivision to read:

(a) A recall election may be held to remove a watershed district's
board of managers from office if:

(1) the Board of Water and Soil Resources has issued, during the term of the current
board of managers, three or more letters of noncompliance to a district for failure to
comply with a requirement of this chapter; or

(2) a recall petition is signed by at least 25 percent of the resident owners residing
in the watershed district.

(b) If the managers are removed from office by a recall election, the county
commissioners of each county responsible for appointing a manager to the watershed
district must appoint successors within 60 days of the recall election. Managers who are
removed from office by a recall election may not be reappointed to fill the vacancies
that are created.
