1.1 A bill for an act 1.2 relating to transportation; permitting new replacement 1.3 transit service in the metropolitan area to be 1.4 established; amending Minnesota Statutes 1994, section 1.5 473.388, subdivision 2. 1.6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.7 Section 1. Minnesota Statutes 1994, section 473.388, 1.8 subdivision 2, is amended to read: 1.9 Subd. 2. [REPLACEMENT SERVICE; ELIGIBILITY.] The council 1.10 may provide assistance under the program to a statutory or home 1.11 rule charter city or town or combination thereof, that: 1.12 (a) is located in the metropolitan transit taxing district; 1.13 (b) is not served by the council bus service or is served 1.14 only with council bus routes which begin or end within the 1.15 applying city or town or combination thereof; and 1.16 (c) has fewer than four scheduled runs of council bus 1.17 service during off-peak hours defined in section 473.408, 1.18 subdivision 1. 1.19 Eligible cities or towns or combinations thereof may apply 1.20 on behalf of a transit operator with whom they propose to 1.21 contract for service. 1.22The council may not provide assistance under this section1.23to a statutory or home rule charter city or town unless the city1.24or town,1.25(i) was receiving assistance under Minnesota Statutes 1982,2.1section 174.265 by July 1, 1984,2.2(ii) had submitted an application for assistance under that2.3section by July 1, 1984, or2.4(iii) had submitted a letter of intent to apply for2.5assistance under that section by July 1, 1984, and submits an2.6application for assistance under this section by July 1, 1988.2.7A statutory or home rule charter city or town has an additional2.812-month extension if it notified the former regional transit2.9board before July 1, 1988, that the city or town is in the2.10process of completing a transportation evaluation study that2.11includes an assessment of the local transit needs of the city or2.12town.2.13 Sec. 2. [APPLICATION.] 2.14 Section 1 applies in the counties of Anoka, Carver, Dakota, 2.15 Hennepin, Ramsey, Scott, and Washington.
