A bill for an act
relating to public safety; making certain fraudulent conduct relating to service
animals a crime; imposing criminal penalties; proposing coding for new law in
Minnesota Statutes, chapter 609.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

As used in this section:

(1) "place of public accommodation" has the meaning given in section 363A.03,
subdivision 34; and

(2) "service animal" has the meaning given in section 343.20, subdivision 7.

A person who, with the intent of wrongfully obtaining money,
property, access to a place of public accommodation, or any other tangible benefit, falsely
represents to another through statements or conduct that an animal the person owns or
controls is a service animal when the animal is not, is guilty of a misdemeanor.

This section is effective July 1, 2018, and applies to crimes
committed on or after that date.
