1.1 A bill for an act 1.2 relating to human services; extending the physician 1.3 surcharge waiver request to a physician whose license 1.4 is issued or renewed on or after April 1, 1992; 1.5 amending Minnesota Statutes 1996, section 256.9657, 1.6 subdivision 1b. 1.7 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.8 Section 1. Minnesota Statutes 1996, section 256.9657, 1.9 subdivision 1b, is amended to read: 1.10 Subd. 1b. [PHYSICIAN SURCHARGE WAIVER REQUEST.] (a) The 1.11 commissioner shall request a waiver from the secretary of health 1.12 and human services to exclude from the surcharge under section 1.13 147.01, subdivision 6, a physician whose license is issued or 1.14 renewed on or after April 1,19931992, and who: 1.15 (1) provides physician services at a free clinic, community 1.16 clinic, or in an underdeveloped foreign nation and does not 1.17 charge for any physician services; 1.18 (2) has taken a leave of absence of at least one year from 1.19 the practice of medicine but who intends to return to the 1.20 practice in the future; 1.21 (3) is unable to practice medicine because of terminal 1.22 illness or permanent disability as certified by an attending 1.23 physician; 1.24 (4) is unemployed; or 1.25 (5) is retired. 1.26 (b) If a waiver is approved under this subdivision, the 2.1 commissioner shall direct the board of medical practice to 2.2 adjust the physician license surcharge under section 147.01, 2.3 subdivision 6, accordingly. 2.4 Sec. 2. [EFFECTIVE DATE.] 2.5 Section 1 is effective the day following final enactment.
