1.1 A bill for an act 1.2 relating to retirement; combination of workers' 1.3 compensation benefits and public pension plan 1.4 disability benefits; exempting certain state employees 1.5 from public pension plan disability benefit offset 1.6 from workers' compensation benefits. 1.7 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.8 Section 1. [EXEMPTION TO STATUTORY OFFSET FROM WORKERS' 1.9 COMPENSATION BENEFITS FOR STATE PENSION PLAN DISABILITY 1.10 BENEFITS.] 1.11 (a) The offset of a Minnesota state retirement system 1.12 disability benefit or retirement annuity otherwise required by 1.13 Minnesota Statutes, section 176.021, subdivision 7, does not 1.14 apply to a person described in paragraph (b). 1.15 (b) A person to whom paragraph (a) applies is a person who: 1.16 (1) was born on July 16, 1961; 1.17 (2) has been employed by the state as a nurse at the Anoka 1.18 metro regional treatment center since November 23, 1979, and 1.19 most recently was a registered nurse, senior; 1.20 (3) is receiving a disability benefit from the general 1.21 employee retirement plan of the Minnesota state retirement 1.22 system under Minnesota Statutes, section 352.113; and 1.23 (4) is totally and permanently disabled under Minnesota 1.24 Statutes, section 176.101, subdivision 5, and is eligible to 1.25 receive workers' compensation benefits as such. 1.26 Sec. 2. [EFFECTIVE DATE.] 2.1 Section 1 is effective on the day following final enactment.
