Providing for a prescription drug access program; requiring prescription
manufacturers or labelers selling prescription drugs through the medical
assistance (MA) program or other publicly supported pharmaceutical assistance
program to enter into agreements with the commissioner of administration for
rebate payments to the state, requiring and providing for the commissioner to
negotiate the rebate amount; requiring participating retail pharmacies covered
by a rebate agreement to discount the retail price of drugs sold to eligible
individuals, requiring the commissioner to establish discounted prices for drugs
covered by the agreements and to promote the use of efficacious and reduced cost
drugs, requiring pharmacies to offer initial and secondary discounted prices by
certain dates; requiring the board of pharmacy to adopt rules requiring
disclosure by participating pharmacies to eligible individuals the amount of
savings resulting from the prescription drug access program; prohibiting the
commissioner from imposing transaction charges on participating pharmacies
submitting claims or receiving payments under the program and specifying certain
duties of the commissioner relating to reimbursement to pharmacies for
discounted prices and certain authorized professional fees and the collection of
utilization data, providing for the confidentiality of certain information;
requiring and providing for commissioner release of the names of manufacturers
and labelers participating and not participating in rebate agreements to health
care providers and the public on a regular basis; requiring the commissioner of
human services to impose prior authorization requirements in the medical
assistance program for the dispensing of prescription drugs provided by
manufacturers and labelers without rebate agreements; requiring and providing
for the resolution of discrepancies in rebate amounts; establishing the
prescription drug fund and appropriating money in the fund to the commissioner
of administration for program administration purposes; requiring the
commissioner to annually report the enrollment and financial status of the
program to the legislature; requiring the commissioner to establish procedures
for determining eligibility and issuing enrollment cards to eligible individuals
and to promote awareness and authorizing the commissioner to contract for
administration of the program; requiring the commissioner in cooperation with
the commissioner of human services to administer the program and other medical
and pharmaceutical assistance programs in an advantageous coordinated manner;
