Relating to healthARTICLE 1 REPEAL OF HEALTH CARE RELATED TAXES; USE OF TOBACCO
SETTLEMENT PROCEEDSRepealing the health care related taxes including the
MinnesotaCare premium and provider taxes, the health insurance premium tax, the
Minnesota comprehensive health association (MCHA) assessment and the health
maintenance organization (HMO) and hospital surcharges, requiring health plan
companies to pass on to purchasers in the form of reduced premium rates the
savings resulting from the repeal and to annually submit documentation of
compliance to the commissioners of commerce or health for enforcement purposes;
requiring the commissioner of finance to deposit tobacco settlement proceeds
into the health care access fund; providing for financial management of the
MinnesotaCare program, prohibiting the commissioner of human services from
expending more funds than appropriated, requiring and providing for the forecast
of projected costs; providing for the contingent repeal of the health care
access fund ARTICLE 2 CONFORMING CHANGES Making conforming amendments to certain
statutory provisions relating to the exemption of staff model health plan
companies from certain extended provider network requirements, health data
collection and tax data disclosure; repealing certain provisions relating to the
MinnesotaCare provider tax, the premium tax on nonprofit health plan companies
and the Minnesota comprehensive health association (MCHA) assessment(ra)
