3E Relating to natural resources

ARTICLE 1- NATURAL RESOURCES TECHNICAL
AMENDMENTS

Modifying certain contractual and grant agreement provisions;
excepting the electronic licensing system commission from certain standing
appropriations in the wild rice management account; exempting certain
snowmobiles from the snowmobile state trail sticker requirements; modifying
sticker placement requirements on snowmobiles; modifying certain provisions
relating to invasive species, adding curly leaf pondweed to the invasive species
program for aquatic plants; extending the Casey Jones state trail to Redwood
Falls to join with the Minnesota River state trail; modifying the Glacial Lakes
trail, Blufflands trail system, Sakatah Singing Hills trail and Willard Munger
trail descriptions; extending the Heartland state trail to originate in Moorhead
in Clay county and extend through Detroit Lakes in Becker county, eliminating
certain eminent domain authority; designating the Great River Ridge state trail
from the city of Plainview through the city of Elgin in Wabasha county and the
town of Viola in Olmsted county to the Chester Woods trail in Olmsted county;
allowing the DNR to mark canoe and boating routes on the Sauk river; modifying
reforestation best methods; modifying the definition of enforcement officer;
modifying water surcharge provisions; modifying water aeration safety
provisions; requiring the commissioner of natural resources (DNR) to enter into
an agreement with the Wabasha county regional rail authority to maintain and
develop the Great River Ridge trail as a state trail; repealing a certain water
aeration safety provision

ARTICLE 2 - POLICY AMENDMENTS

Modifying certain
provisions regulating all-terrain vehicles; modifying critical habitat private
sector matching account requirements; defining certain hunting terms; requiring
the commissioner of finance to credit the game and fish account with money
received from lands acquired by the state for game and fish purposes or by
purchase or gift; modifying the dedication of certain funds derived by
prosecutions and violations of certain game and fish laws; clarifying the use of
revenue derived from deer, bear and lifetime licenses; providing for resident
petition against designation of a game refuges on private land; modifying
restrictions on motorized watercraft and recreational vehicles in wildlife
management areas; modifying procedures and conditions for the commissioner of
natural resources (DNR) to confiscate property used in game and fish law
violations, requiring commissioner reimbursement for sold, lost or damaged
property under certain conditions; providing for inspection of equipment used to
take wild animals; imposing a civil penalty for dog owners pursuing big game;
authorizing the commissioner to establish special hunts for military personnel;
modifying resident and nonresident hunting licenses; modifying trapping
licenses; clarifying the usage of tags when possessing and transporting a deer,
bear, elk, or moose; prohibiting a parent or guardian from directing, allowing
or permitting a person under a certain age to possess a firearm under certain
conditions; modifying restrictions on using an artificial light to locate fox or
coyote; regulating the collecting of antler sheds; modifying certain all season
deer license and limits requirements; prohibiting smokeless gunpowder use in a
muzzle-loaders during muzzle-loading season; clarifying the type of shotguns
permitted during the regular firearms season, defining the shotgun use area;
modifying reporting requirements for deer other than white-tailed or mule deer;
clarifying areas persons are restricted to use fishing boats and motorboats;
allowing the commissioner to modify restrictions on and the permit application
process for fishing contests; limiting the number of fishing contests; modifying
conditions for transporting fish; modifying limitations on spearing from dark
houses; requiring the commissioner to amend a certain rule to allow operating an
all-terrain vehicle (ATVs) or a snowmobile on privately owned land in an area
open to taking deer by firearms during the legal shooting hours of the deer
season under certain conditions; requiring the commissioner to modify the spring
turkey season length of day to sunset; requiring the commissioner to report to
the legislature by a certain date on the impact of limiting the number of
pheasants allowed in the pheasant season; making certain conforming and
rulemaking changes; requiring the commissioner to amend certain spearing of fish
rules; specifying commissioner of transition provisions relating to all terrain
vehicles; repealing certain restrictions for nonresident fish houses

ARTICLE 3
- ADDITIONAL POLICY AMENDMENTS

Authorizing the commissioner of natural
resources (DNR) to reimburse land donors for costs incurred in obtaining
appraisals needed for tax reporting purposes, limit; authorizing the
commissioner to acquire interests in land by gift, purchase or lease for
facilities outside the boundaries of state parks, state recreation areas and
state waysides; requiring certain gross receipts sales from the Iron Range off
highway vehicle recreation area to be deposited in the natural resources fund
dedicated accounts; requiring the commissioner to prescribe and issue temporary
state park permits for towed vehicles; exempting Soudan underground mine state
park from state park permit and fee requirements; expanding state park permit
fee requirements to include annual state park permit fees for motorcycles;
modifying forester services provided to private owners; authorizing the
commissioner to by written order establish fees for the state forest lands,
requiring collected fees to be credited to the forest land use account;
modifying state timber auction sales procedures, specifying purchaser
qualifications and preregistration; modifying the definition of exploratory
boring; extending the individual sewage treatment system (ISTS) pilot program;
authorizing the Lower Minnesota River watershed district to acquire, maintain,
operate, improve and enlarge a site for the deposit of dredge material, issue
and sell general obligation bonds or revenue bonds; permitting private
customers to deposit dredge material at the site, fees; clarifying the
application of certain storm water rules to counties; repealing the forest
resource management plan and petitioners bond requirements for termination of
watershed districts

ARTICLE 4 - ECONOMIC DEVELOPMENT

Adding Explore Minnesota
tourism to the appointing authorities permitted to designate additional
unclassified positions; providing an exemption under franchise regulations for
marketing of motor fuel, specifying qualifying conditions; exempting motor fuel
franchises from certain regulations; modifying provisions relating to petroleum
fund compensation for transport vehicles; requiring the rural policy and
development center to submit biennial reports on the status of rural Minnesota
to the legislature by a certain date; modifying grant use requirements for
preemployment training programs under the job skills partnership; modifying the
definition of inland waters, excluding boundary lakes and rivers; extending the
PUC utility assessment and appropriation under energy planning; extending
certain financial assistance for certain renewable energy facilities; placing
the office of the commissioner of the iron range resources and rehabilitation
board (IRRRB) in the executive branch of state government as an agency; allowing
the IRRRB commissioner to lease surface and mineral interests owned or acquired
by the state; requiring the IRRRB commissioner to annually submit a prepare
budget to the board (IRRRB) and governor and to prepare a list of projects with
the IRRRB; making technical changes to taconite area environmental protection
fund provisions; requiring the commissioner to present a long range plan to
governor and legislature for the Douglas J. Johnson economic protection trust
fund; requiring maintenance of a camping area for the Minnesota street rod
association annual event held on the state fair grounds; providing for the
employment of the executive director of the public facilities authority in the
unclassified service; modifying the duration limit for job opportunity building
zones (JOBZ) under certain conditions; providing for a transfer of funds from
the metropolitan landfill contingency action trust account to the commissioner
of finance for transfer to the renewable development account

ARTICLE 5 -
MISCELLANEOUS

Requiring the commissioner of natural resources to restrict
wildlife feeding
within a certain radius of a cattle herd infected with bovine
tuberculosis;
granting legislative approval for the consumptive use of
groundwater under a permit in Itasca county in connection with an innovative
energy project facility, subject to commissioner of natural resources (DNR)
determination of the adequacy of water remaining in the basin of origin to meet
the need for water and approval by the commissioner of applicable permits
