Regulating unsolicited telephonic sales calls (telemarketing); requiring
registration of telephone solicitors making unsolicited telephone sales calls
with the commissioner of commerce; prescribing the registration procedure;
providing for registration renewal and requiring certain fees, requiring
crediting to a special account and appropriating money in the account to the
commissioner for administrative expenses; providing for residential telephone
subscribers placement on a no sales solicitation calls list through notice to
the department of commerce; requiring periodic updating of the list by the
department for telephone solicitors access purposes, fee, requiring free lists
to trade associations acting on behalf of telephone solicitors, requiring
crediting of fee amounts to an account in the special revenue fund and providing
an annual appropriation to the commissioner for administration purposes;
prohibiting solicitor unsolicited telephonic sales calls to numbers on the list;
requiring the department to notify telephone subscribers inquiring about the no
call list of the availability of the telephone preference service operated by
the direct marketing association (DMA) and the procedures for listing on the
telephone preference service or other national no call lists, exempting
telephone solicitors subscribing to and complying with the national no call
lists from the requirements of the state list; restricting solicitor electronic
charges resulting from preacquired account telephone calls, disclosure
requirement; prohibiting solicitor interference with caller identification (ID)
services; requiring the commissioner to include Minnesota subscribers on a
national no call list maintained by the federal communications commission (FCC)
on the state list; classifying and restricting the release of information
contained in the list; requiring telephone companies to inform customers of the
right to be placed on no sales solicitation call lists; granting the
commissioner certain enforcement powers, declaring violations as a deceptive
practice and authorizing attorney general civil actions for violations(mk)
