E Relating to transportation ARTICLE 1 � TRANSPORTATION POLICYAuthorizing
the commissioner of transportation (DOT) to allow two way+ operation of
snowmobiles on either side of trunk highway rights-of-way under +certain safety
determination conditions, authorizing the commissioner to +prescribe conditions
of operation; expanding the rules adoption requirement of +the commissioner of
public safety relating to accident prevention courses+ taken by senior citizens
for automobile insurance premium reduction purposes +to allowing for recognition
of courses taken in other states; modifying certain +appraisal and negotiation
requirements for the acquisition of property for +transportation purposes,
classifying certain appraised values data and requiring the commissioner of
transportation to prepare a publication summarizing +the eminent domain process
for transportation projects; authorizing and providing+ for the commissioner to
enter into lease agreements with public, nonprofit or+ private entities for the
use of safety rest areas and travel information +centers; authorizing sales of
certain travel or tourism related merchandise by+ the commissioner at rest
areas; authorizing the commissioner to enter +into agreements for public or
private sponsorship of rest areas by +transportation or tourism related
entities; authorizing the sale of surplus rest area +property and appropriating
the proceeds to the commissioner for sale costs, +establishing a safety rest
area account in the trunk highway fund to fund the rest+ areas; changing the
travel information franchise program to the travel +information advertising
program and authorizing and providing for commissioner +lease of advertising
space under the program and for certain vendor +agreements, authorizing the
commissioner of transportation and the director of +the office of tourism to
enter into an interagency agreement to define the +distribution of revenues
under the program; requiring and providing for the +commissioner to prepare and
adopt by a certain date a draft road toll facilities plan+ covering a certain
period of time, specifying certain plan requirements and +certain toll facility
development agreement restrictions and providing for the +inclusion of toll
facilities in the statewide transportation improvement program; prohibiting the
commissioner from charging user fees to owners or +operators of singly occupied
hybrid or inherently low emission vehicles (ILEV) +with decals using designated
high occupancy vehicle (HOV) lanes, providing for +issuance of the decals by the
motor vehicle registrar and exempting the vehicles +from toll charges, defining
hybrid and inherently low emission vehicles; +eliminating the requirement for
the commissioner to appoint local advisory committees+ to review the designation
of natural preservation routes on county state aid +highways; expanding the
requirement for the establishment of cartways to +landowners with access to the
land only over navigable waterways; prohibiting the +issuance of vehicle
registrations, license plates or permits to vehicles assigned+ to commercial
motor carriers prohibited from operating in interstate +commerce by a federal
agency; requiring legislative approval of certain rules +adopted by the
commissioner of public safety relating to deputy motor vehicle +registrars;
modifying certain requirements for motor vehicle dealer certificates +of title
for vehicles sold to out of state buyers; modifying the authority of +local
authorities to establish school zone speed limits, establishing a +maximum speed
limit for school zones; restricting the unauthorized use or +possession of
traffic signal override devices designed to change a traffic signal; prohibiting
certain motor vehicle speed contests (races), penalty; +prohibiting the
operation of motor vehicles by holders of instruction permits or provisional
drivers licenses while operating a cellular or wireless +telephone (cellphone),
excepting operators of emergency vehicles and motor +vehicle passengers;
defining appropriate reduced speed in approaching or +passing emergency vehicles
stopped on highways with emergency lights +flashing, increasing the surcharge on
the fine for failure to drive at an +appropriate reduced speed under certain
illuminated or reflective warning markers+ placement conditions and requiring
the commissioner of public safety to ensure +the provision of instruction to
persons enrolled in driver education or +training programs in the
responsibilities of drivers approaching emergency +scenes and stopped emergency
vehicles, authorizing peace officers to arrest +motor vehicle drivers after
violation upon probable cause and imposing a penalty; +requiring vehicles to be
driven in the right hand lane of freeways, expressways+ and laned highways,
exceptions; regulating the operation of motorized scooters;+ excluding certain
light rail (LRT) vehicle tracks at certain intersections from+ the requirement
for certain vehicles to stop at railroad grade crossings; prohibiting leaving a
child under a certain age unattended in a +passenger vehicle under certain
conditions, prescribing fines for violation; +authorizing buses used to
transport adults to and from day activity centers to be+ equipped with school
bus prewarning flashing amber signals and stop signal +arms; requiring motor
vehicle operators to fasten children between certain +ages in booster seats,
exceptions; expanding the seat belt requirement to all passengers in a passenger
or commercial motor vehicle, making +violation of the requirement a primary
offense and increasing the fine for violation, +dedicating the increase to
county detoxification services for drug dependent +persons; authorizing
registered motor carriers of passengers to operate +articulated buses exceeding
certain length limits; excepting vehicles hauling +unfinished forest products
and certain additional recycling and garbage trucks +from certain highway weight
limits; prohibiting the issuance of drivers +licenses or instruction permits to
persons convicted of driving while impaired +(DWI), underage drinking and
driving, violations of the open bottle or +implied consent laws or a crash
related moving violation, specifying certain +conditions for reinstatement or
issuance of drivers licenses after conviction; +extending the validity of
instruction permits; modifying the restrictions on the +use of provisional
drivers licenses; authorizing peace officers to operate +any vehicle or
combination of vehicles while on duty; authorizing the department +of public
safety to accept advanced hunter certificates issued for successful +completion
of an advanced hunter education course for firearms safety +designation
identification on drivers licenses; requiring the inclusion of +certain
additional safety regulations in the drivers manual and on drivers +tests;
requiring drivers license renewal applicants warned or having +attended
preliminary hearings as habitual violators and applicants at fault in+ multiple
crashes or with suspended driving privileges as habitual violators to+ pass
written or road examinations; requiring revisions of the state +transportation
plan to include a chapter setting out a state aviation plan, +specifying certain
plan content requirements and requiring the commissioner of +transportation to
create a temporary advisory council on aviation planning to advise +the
commissioner on the chapter; establishing a rural road safety account+ in the
local road improvement fund and providing for application for grants +or loans
from the trunk highway corridor projects account and local road +account for
routes of regional significance; requiring the commissioner to +develop a plan
for a statewide system of ten ton county and county state aid +highways;
conforming certain driver hours of service restrictions to certain +federal
regulations; regulating the transportation of animals on public +roadways in the
cargo portion of a motor vehicle; prohibiting the closure of +municipal airports
without a notice of intent to the commissioner, defining municipal +airport;
modifying certain regulations relating to review of plans for +subdivision of
lands abutting trunk highways; expanding the definition of +appropriate agency
under the criminal forfeiture law to the division of driver and +vehicle
services in the department of public safety relating to drivers +license or
identification card transactions; clarifying the crime of unlawfully +obtaining
transit services in the metropolitan area; placing a moratorium on +commissioner
of transportation closing or substantially reducing the hours of +operation of
certain trunk or interstate highway safety rest areas; requiring the
commissioner of administration to develop a plan to allow deputy +registrars to
avoid or minimize the payment of transaction fees and costs relating +to the
acceptance of credit card charges and to report the plan to the +legislature by
a certain date; establishing a town road sign replacement program; +requiring
the commissioner of administration to review and report to the +legislature by
a certain date on the department of transportation right of way +acquisition
practices including the use of eminent domain; specifying certain +renumbering
and cross reference change instructions to the revisor of statutes; +repealing
certain Minnesota state transportation fund dispersal requirements ARTICLE 2 �
CAPITAL PROJECTSAppropriating money to the commissioner of transportation for
design, construction, furnishing and equipping of certain statewide building
+projects, for feasibility studies, design, site preparation and upgrade of
+common utility services for a joint use truck station and public works facility
in +Pope county, for repair and renovation of the exterior of the DOT +building,
for a Mankato headquarters building and for construction of a permanent +flood
control perimeter dike along the south and east edges of the St. Paul +downtown
airport/Holman field and to the commissioner of employment and +economic
development (DEED) for a grant to the city of Buffalo Lake to design, construct,
furnish and equip a municipal maintenance garage and to +reconstruct city
streets damaged by a tornado, authorizing the issuance of state +bonds for
certain projects; authorizing a DOT commissioner grant to the Duluth +port
authority to determine the cause of freshwater corrosion of harbor +sheet piling
