Relating to telecommunications; defining telecommunications terms; establishing
state telecommunications and broadband goals; specifying public utilities
commission (PUC) jurisdiction; requiring the PUC to determine rules for wire
crossing or paralleling utility lines; terminating alternative regulation plans;
granting PUC authority for wholesale telecommunications services; specifying
requirements for schedules, tariffs, and individual contracts; establishing
provider certification, registration, and mapping; requiring the PUC to
establish a universal service fund; requiring annual universal service funding
certification; defining public right-of-way terms; specifying use and regulation
of public right-of-way, a combined local access surcharge, and a combined per
number fee; establishing the telecommunications access Minnesota program and a
fund with appropriation and specifying communication device eligibility
requirements; requiring contracting for relay service; providing adequate
service enforcement, antislamming, and long-distance providers notice and
disclosure requirements; regulating loading; prohibiting billing for
unauthorized charges; regulating private shared services; providing for the
telephone assistance plan (TAP) development and a fund with an appropriation;
defining call location information and disclosure; requiring acquisition by
condemnation PUC notice; requiring PUC regulatory expenses assessment and
proprietary information protection; providing PUC administrative proceedings,
appeals, remedies, penalties, injunction, and private cause of action
prohibition; transferring all telecommunications duties from the department of
commerce to the PUC; repealing all current telephone, telegraph, and
telecommunications statutes and certain state agency rules
