Creating the department of crime victims and violence prevention to merge crime
victims services and violence prevention programs into one department in the
executive branch under the administrative control of a commissioner to be
appointed by the governor with the advice and consent of the senate, specifying
certain duties of the commissioner including the establishment of a criminal
gang prevention and intervention grant program and account; transferring certain
responsibilities of the departments of corrections, public safety, human
services, children, families and learning, health and economic security and of
the office of drug policy and violence prevention, the bureau of criminal
apprehension (BCA) and the supreme court to the department; providing for the
salary of the commissioner; adding the commissioner to the membership of the
child abuse prevention and drug abuse resistance education (DARE) advisory and
chemical abuse and violence prevention councils and providing for appointment of
an abused child program manager; modifying certain membership representation
requirements and duties of the abused children program advisory council;
expanding or specifying certain conflict of interest prohibitions; providing for
a director of the office of drug policy and violence prevention; changing the
due date for the annual home visiting program evaluation report; authorizing
county sheriffs or chief administrative officers of municipal police departments
to apply for undercover buy fund grants and providing for the confidentiality of
applications for the grants; granting the criminal gang strike force certain
property seizure authority and providing for distribution of money or proceeds
from sales of the property by the criminal gang oversight council; modifying the
definition of victim; requiring domestic abuse prosecution plans to be kept on
file with the department and requiring the commissioner of crime victims and
violence prevention in consultation with the battered women advisory council to
evaluate the effectiveness of the prosecution plan pilot program; requiring
involvement of the commissioner in the adoption of standards governing
electronic monitoring devices used to protect victims of domestic abuse;
requiring the commissioner to consider recommendations of the appropriate
advisory council before awarding grants or adopting policies or procedures
relating to programs and services for victims and specifying certain duties of
grantees; requiring and providing for the commissioner in consultation with the
sexual assault and general crime victims advisory councils to award grants to
programs providing direct advocacy, support services, community education,
professional training and systems change activities for crime victims; modifying
certain sexual assault, battered women and general crime victims advisory
council membership representation requirements and duties and providing for
program managers; specifying certain membership representation requirements of
the crime victims reparations board and the crime victim and witness advisory
council, modifying certain duties of the council and requiring commissioner
appointment of board and council program managers; transferring the
responsibility for operation of the crime victim services telephone line from
the commissioner of public safety to the office of the crime victim ombudsman;
specifying certain renumbering and cross reference change instructions to the
revisor of statues; appropriating money to the commissioner of crime victims and
violence prevention for department administration purposes; repealing certain
abused child and battered women programs and victims services provisions, the
crime victim crisis center and the crime victim services roundtable (rla)
