E Authorizing the commissioner of administration to temporarily use a design
build method of project development and construction for state buildings
awarding design build contracts on a design based selection process basis
without competitive bids or to preselect contractors and negotiate a guaranteed
maximum price with optional bidding of subcontracts and sharing of savings,
authorizing the commissioner to require designers and preselected contractors to
cooperate and function as a team; granting the same authority to the board of
regents for university of Minnesota construction projects and to the board of
trustees of the Minnesota state colleges and universities for MnSCU construction
projects; defining design builder under designer selection board provisions and
requiring and establishing a temporary process for the board to select design
builders; providing for design build and preselection construction contracts
under the state procurement process; specifying the authority and certain
requirements of the commissioner under the process, requiring commissioner and
university of Minnesota and MnSCU adoption of exempt rules establishing
procedures for the solicitation and award of design build contracts or the
preselection of contracts; specifying certain designer selection board proposals
solicitation restrictions and providing for certain stipends; specifying certain
design builder licensing requirements; requiring and providing for the
development of design criteria packages; providing for the solicitation,
evaluation and acceptance of proposals, specifying certain duties of the board
and certain options of the commissioner; establishing the design based selection
process; prescribing the process for preselection of contractors, specifying
certain request for proposals and contractor response requirements; authorizing
the commissioner to require a bid bond; requiring the commissioner to accept the
proposal best meeting the weighted evaluation criteria in the request, requiring
perceived benefits of higher priced proposals to merit the additional cost;
requiring commissioner evaluation of contractor experience, technical
competence, performance capability and past performance; authorizing the
designer selection board to require clarification or further information;
requiring capitol area architectural and planning board (CAAPB) participation in
the evaluation process for projects within the capitol area (mk, ja)
