3E Relating to crime and public safety

ARTICLE 1 - CRIMINAL AND CIVIL
PROVISIONS

Defining the crime of trafficking in persons for the purpose of
debt bondage, forced labor or services, slavery or the removal of organs through
coercion or intimidation; defining certain terms; specifying certain unlawful
conduct relating to identification documents; consent or age of the victim not
to be a defense; imposing civil and corporate liability in addition to potential
criminal liability; expanding the crime of promoting prostitution to conduct
involving sex trafficking, providing for an affirmative defense; subjecting
certain property involved in trafficking to forfeiture and providing for
disposition of proceeds from the sale of the property and of property associated
with prostitution, requiring a certain portion to be forwarded to the
commissioner of public safety for distribution to trafficking offense crime
victims services organizations, requiring annual commissioner reports to the
legislature on the use of the money distributed; imposing certain statutes of
limitation

ARTICLE 2 - DEPARTMENT OF PUBLIC SAFETY: ASSESSMENT OF TRAFFICKING
IN MINNESOTA; PLANS TO ADDRESS AND PREVENT TRAFFICKING; ASSESSMENT OF SERVICES
FOR TRAFFICKING VICTIMS

Requiring and providing for a statewide trafficking
assessment by the commissioner of public safety, authorizing contracts for
outside services and providing for the collection of data, requiring a
commissioner report to the legislature by a certain date, specifying certain
report content requirements and requiring commissioner annual publication of
statistical data on the extent and nature of trafficking in the state; requiring
the commissioner to analyze the data collected to develop and carry out a plan
to address current trafficking and prevent future trafficking in the state,
specifying certain plan content requirements; requiring the commissioner to
provide and strengthen training for law enforcement, prosecutors, social
services and other officials in addressing trafficking, specifying certain
training content requirements, requiring the provision of training plans and
materials to the board of peace officer standards and training (POST) and to
establish public awareness programs to educate persons at risk of trafficking
and victimization and the public on the extent of the crime, requiring
commissioner annual evaluation of the training and awareness initiatives for
effectiveness; specifying certain trafficking victim assistance requirements of
the commissioner, requiring establishment of policies and appointment of an
advisory committee on trafficking, specifying certain committee membership
representation requirements; requiring commissioner appointment of a statewide
trafficking coordinator to assist in fulfillment of the duties and
responsibilities

ARTICLE 3 - APPROPRIATIONS

Appropriating money to the
commissioner of public safety for use in the prevention of human trafficking and
for implementation of the initiatives
