Relating to the power of attorney

ARTICLE 1 - GENERAL PROVISIONS AND
DEFINITIONS

"Uniform Power of Attorney Act"; defining certain terms; specifying
scope, exceptions and exclusions of the power of attorney; providing for the
power of attorney as durable, exception for incapacity of principal; providing
for execution, validity and interpretation of power of attorney; authorizing a
principal to nominate a conservator or guardian for consideration by the court
under certain conditions and providing for relation of agent to court appointed
fiduciary; providing when power of attorney is effective; providing termination
of power of attorney; authorizing a principal to designate coagents and
successor agents under certain conditions; entitling agents to reimbursement and
compensation of expenses; specifying certain duties of agents; providing for
exoneration of agents; authorizing a court to construe a power of attorney under
certain conditions, providing for judicial review under certain conditions,
providing for appropriate relief; specifying agents liability for violations;
specifying certain agent resignation and notice requirements; providing for
protection of person dealing with agent; specifying liability for persons
refusing to accept agents authority; requiring principles of law and equity to
supplement the act; specifying remedies under other law

ARTICLE 2 -
POWERS

Specifying certain agent powers upon granting power of attorney
authority, specifying certain powers requiring express authorization;
authorizing agents to incorporate certain powers; providing for construction of
powers generally; specifying certain agent powers relating to real property,
tangible personal property, stocks and bonds, commodities and options, banking
and other financial transactions, operation of an entity or business, insurance
and annuities, estates, trusts and other beneficial interests, claims and
litigation, personal and family maintenance, benefits from governmental programs
or civil or military service, retirement plans, taxes, and gifts

STATUTORY FORM POWER OF ATTORNEY

Providing an optional form to be used to
create a power of attorney

ARTICLE 4 - MISCELLANOUS PROVISIONS

Providing for
relation to the electronic signatures in global and national commerce act and
providing the effect on existing powers of attorney; repealing current power of
attorney provisions
