E Relating to human services; authorizing the commissioner of human services to
enter into contractual agreements with federally recognized Indian tribes to
allow the tribes to receive direct federal and state reimbursement for the
operation of placement programs for Indian children; modifying certain
provisions providing state foster care maintenance payments to counties;
requiring and providing for commissioner of human services reimbursement to
counties of the cost of child family foster care, specifying certain
requirements of counties for eligibility for full reimbursement, reimbursement
by the child or the parent for the costs of care not to alter the amount of
reimbursement received by a county; requiring counties receiving reimbursements
to annually dedicate a certain percentage of local dollars spent on child family
foster care for prevention and early intervention in child welfare to reduce the
number of out of home placements, requiring commissioner annual review of county
expenditures, authorizing commissioner reduction, suspension or waiver of the
requirement under certain determination conditions; specifying certain county
performance measures for receipt of out of home placement aid and certain duties
of the commissioner and county social service representatives, requiring certain
commissioner reports to the legislature relating to adjustment of payments to
counties failing to meet expenditure requirements and the effectiveness of
family preservation and out of home placement aids in meeting the goals of
reducing property tax burdens and out of home placement costs; requiring the
commissioner to study foster care and the adoption and relative custody
assistance programs, specifying certain study requirements and requiring a
report with findings and recommendations to the legislature by a certain date;
repealing certain rulemaking requirements of the commissioner and the obsolete
difficulty of care assessment pilot project (ra, ja)
