Requiring the commissioner of transportation (DOT) to prepare and adopt by a
certain date a draft road toll facilities plan covering a certain period of
time; requiring the plan to ensure toll facilities consistency with regional
transportation plans, coordination with other highway and transportation
improvements and construction to meet certain transportation needs, specifying
certain plan content requirements; specifying certain cost benefit analysis
requirements of local road authorities for development agreement signing
purposes; requiring the plan to require development agreements to provide
significant advantages, benefits or preferences to public transit and other high
occupancy vehicles (HOV) and to be approved by planning organizations in
metropolitan areas slated for facility location, requiring the commissioner to
submit draft plans to the organizations by a certain date, failure of the
organizations to act on the draft plans by a certain later date to constitute
approval; specifying certain required operational aspects of the plan;
prohibiting toll facility agreements containing provisions prohibiting or
restricting construction of competing transportation facilities in proximity to
the new toll facility from prohibiting or restricting the development, design,
construction or operation of public transit facilities; requiring inclusion of
toll facilities in the statewide transportation improvement program before
entering into development agreements for the facilities; requiring the
commissioner to include descriptions of toll facilities developed under
development agreements in the biennial budget document submitted to the
legislature, specifying certain description content and summarization
requirements
