E "Department of Human Services Background Studies Act", recodifying+ and
reorganizing the background study provisions in the human services +licensing
act ARTICLE 1 � BACKGROUND STUDIES Requiring and providing for commissioner of
human services background+ studies for human services licensing purposes;
defining certain terms; +specifying the licensed programs requiring background
studies; requiring background +studies upon application for initial licenses and
upon reapplication under +certain child and foster care programs, exempting
certain adult foster care +license holders from the reapplication background
check requirement under +certain conditions; providing for the submission and
treatment of data +presented by individuals to the commissioner for study
purposes; authorizing the commissioner to request the provision of fingerprints
under certain +conditions; specifying certain notice requirements; providing for
the study of +individuals previously studied or affiliated with multiple
licensed facilities; +specifying the information to be reviewed by the
commissioner including juvenile+ court records; requiring license
disqualification for failure to cooperate; specifying authorized fees; providing
for background studies on +individuals in county and jointly licensed programs,
authorizing the sharing of +certain data; providing for commissioner processing
of background study forms; +specifying conditions requiring license
disqualification, providing for +disqualification from direct contact for
certain crimes or conduct, prohibiting +disqualification for mental illness and
providing for the determination of immediate +risk of harm and for removal of
