5E Relating to health; providing for the medical use of marijuana in the
treatment of certain debilitating medical conditions; providing criminal and
civil penalties; setting an expiration date for medical use of marijuana
provisions; providing for the classification of data by commissioner of health;
defining certain terms; providing protections for the medical use of marijuana
by certain qualifying patients and primary caregivers, limiting the amount
allowed to be in possession; providing for dismissal of charges under certain
conditions; prohibiting discrimination against qualifying patients or primary
caregivers by schools, employers or landlords; providing an affirmative defense
of medical use of marijuana for defense purposes; providing for reimbursement to
primary caregivers for certain costs; protecting practitioners recommending the
medical use of marijuana from arrest in certain situations, prosecution or
penalties; protecting the marijuana from seizure; prohibiting the arrest and
prosecution of persons in the presence or vicinity of the medical use of
marijuana under certain conditions; authorizing licensed nursing facilities or
boarding homes to adopt medical marijuana use restrictions; specifying maximum
amounts of medical marijuana to be received by a qualifying patient; requiring
and providing for the commissioner to issue registry identification cards to
qualifying patients and primary suppliers, authorizing issuance to minors under
certain conditions; specifying certain identification card content requirements
and requiring rules for the consideration of applications, for renewals and
fees; requiring qualifying patient or supplier notice to the commissioner of
certain changes, imposing a civil penalty for violation, requiring commissioner
issuance of new cards or voidance of existing cards under certain conditions;
providing for the replacement of lost cards; classifying registration
application and supporting data as private and requiring commissioner to
maintain a list of persons and specifying conditions for release of data;
authorizing certain delivery services and imposition of charges by registered
organizations; requiring annual commissioner reports to the legislature on the
number of applications and approvals and on the nature of the debilitating
medical conditions; imposing penalties for submission of false records or
documentation for organization certification purposes; requiring criminal
history background checks of primary caregivers before issuance of a registry
identification card; providing for construction and interpretation of the
provisions; imposing certain penalties for fraudulent representation to law
enforcement officials; allowing affirmative defense and dismissal for medical
marijuana under certain conditions; severability clause; requiring and providing
for registration of organizations supplying the marijuana for medical use,
specifying certain requirements of the organizations; subjecting registered
organizations to reasonable inspection by commissioner; specifying organization
requirements and prohibitions, requiring organizations to be nonprofit entities;
requiring implementation of security measures, prohibiting registered
organizations from dispensing more than a certain amount of usable marijuana to
a qualified patient or caregiver on behalf of a patient, requiring criminal
background checks and specifying certain duties of the bureau of criminal
apprehension; prescribing felony penalties; sunset provision; specifying certain
implementation requirements for registry identification cards and registered
organization licenses; appropriation to commissioner of health to implement the
medical marijuana law
